Mediation is private, voluntary process conducted by a neutral third party (the mediator), who assists the disputing parties to work towards the settlement of their dispute. The parties control the decision to settle and determine the terms of their resolution.

Mediation counters the combative court system and seeks to resolve defined issues. This process gives the parties the platform to directly communicate and negotiate with each other to secure an agreement that is mutually beneficial. Thus, in comparison to the customary methods of resolving disputes through the court system, mediation is based on the notion of self determination. That is, the parties hold the decision making power and control the outcome of their dispute.

Mediation of business disputes is usually less expensive and less time-consuming compared to litigation. Mediation also provides the opportunity to resolve a dispute in a non-adversarial manner so that valuable business relationships may continue.

PANEL OF MEDIATORS

The role of the Mediator is to effectively manage the process, to clearly identify the interests and goals of the Parties and to collate and develop necessary information to be shared. The Mediator facilitates the mediation discussions and gives feedback to the parties on the issues from a neutral perspective, assisting the parties to reach a mutually beneficial resolution.

The Mediation Panel of ADR Services Ltd is comprised of carefully selected, experienced neutrals drawn from a deliberate cross section of industry and business locally and regionally. Our Panel of neutrals spans the construction sector, financial services, maritime, manufacturing, insurance and other commercial sectors. Each Mediator brings deep commercial and dispute resolution capability in the relevant sector understanding its nuances, protocols and industry framework. These insights, coupled with mediation experience positions the Mediator to be uniquely able to assist and guide (where appropriate) the parties to a mutually satisfactory resolution of their dispute.

Our Mediators have been certified by the Mediation Board of Trinidad & Tobago and other internationally recognized governing bodies. All Mediators on the Mediation Panel abide by the Code of Ethics set out in the Mediation Act of Trinidad and Tobago, Chapter 5:32, and with the provisions of the Act.
